Ezia Athletic Club (“Ezia,” “we,” “our,” or “us”) is committed to protecting the privacy and security of your personal and health-related information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website, use our digital services, or interact with our physical facility. This Policy complies with applicable federal and state privacy laws, including, where applicable, the California Consumer Privacy Act (CCPA) and the Health Insurance Portability and Accountability Act (HIPAA) for any covered health data.
 

By using our website or services, you consent to the data practices described herein. If you do not agree with the terms of this Privacy Policy, please do not access or use our services.
 

1.1  Information We Collect
 

We may collect the following categories of personal information:

  • Personal Identification Information: Full name, email address, telephone number, and mailing or billing address.

  • Membership & Fitness Data: Fitness goals, exercise history, physical assessment results, class registrations, facility attendance records, and any health information voluntarily disclosed to personal trainers or staff for program design purposes.

  • Payment & Financial Information: Billing address and payment method details processed securely through PCI-DSS-compliant third-party payment processors. Ezia does not store full payment card numbers, CVV codes, or associated authentication data on its own servers.

  • Technical & Digital Data: Internet Protocol (IP) addresses, browser type, operating system, referring URLs, pages viewed, session duration, and cookie identifiers collected to operate, maintain, and improve our website experience.

  • Communications: Records of correspondence sent to or received from Ezia, including support requests, feedback, and inquiries.
     

1.2  How We Use Your Information
 

We use the information we collect for the following purposes:

  • Account & Membership Management: To create and administer your membership account, process billing, track attendance, and deliver member benefits.

  • Service Delivery: To provide personalized fitness programming, schedule classes, coordinate with trainers, and fulfill any other services you request.

  • Safety & Emergency Communications: To notify you of important safety notices, facility changes, emergency closures, or health-related updates pertinent to your membership.

  • Marketing & Promotional Communications: To send newsletters, offers, and event information. You may opt out of marketing communications at any time by following the unsubscribe link in any email or by contacting us directly. Opting out will not affect transactional or service-related communications.

  • Legal Compliance & Fraud Prevention: To comply with applicable laws, respond to legal process, enforce our agreements, and protect the rights, property, or safety of Ezia, its members, and the public.

  • Analytics & Improvement: To analyze usage patterns, evaluate website performance, and improve our digital and in-person offerings.
     

1.3  Data Sharing and Disclosure
 

Ezia does not sell, rent, or trade your personal or health information to third parties for their own marketing purposes. We may share your information only in the following limited circumstances:

  • Service Providers: With vetted third-party vendors who perform services on our behalf—such as gym management platforms, payment processors, email marketing services, and IT support providers—solely to the extent necessary to deliver those services and subject to confidentiality obligations no less protective than those described here.

  • Legal Obligations: When required to do so by applicable law, regulation, court order, or governmental authority, or when disclosure is necessary to protect the rights or safety of Ezia, its members, or others.

  • Business Transfers: In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred as part of that transaction, subject to standard confidentiality protections.

  • With Your Consent: In any other circumstance with your prior explicit consent.
     

1.4  Data Security
 

We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, disclosure, alteration, or destruction. These measures include encryption of data in transit (TLS/SSL), access controls, and regular security assessments. Notwithstanding our efforts, no method of electronic transmission or storage is completely secure. We cannot guarantee absolute security and encourage you to use a strong, unique password for your account.
 

1.5  Data Retention
 

We retain personal information for as long as your membership is active and for a reasonable period thereafter to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements. Health and fitness data may be retained in anonymized form for business analytics purposes.
 

1.6  Your Privacy Rights
 

Depending on your jurisdiction, you may have rights to: (a) access, correct, or delete your personal information; (b) restrict or object to certain processing activities; (c) data portability; and (d) withdraw consent where processing is based on consent. California residents may also have rights under the CCPA, including the right to know the categories of personal information collected about them and to request deletion. 1.7  Cookies and Tracking Technologies
 

Our website uses cookies, web beacons, and similar technologies to enhance your browsing experience, remember your preferences, and gather analytics data. You may control cookie settings through your browser preferences; however, disabling cookies may limit certain website functionality. We do not currently respond to browser Do Not Track (DNT) signals.

2. Terms of Use

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Ezia Athletic Club (“Ezia,” “we,” “our,” or “us”) governing your access to and use of the Ezia website (the “Site”), mobile applications, and physical facilities (collectively, the “Services”). By accessing the Site or using the Services, you affirm that you are at least eighteen (18) years of age (or the age of majority in your jurisdiction), have read and understood these Terms, and agree to be legally bound by them.


If you do not agree to these Terms, you must immediately discontinue all use of the Site and Services. Ezia reserves the right to modify these Terms at any time. Continued use of the Services following the posting of revised Terms constitutes your acceptance of those changes.
 

2.1  Health & Safety Disclaimer
 

Physical exercise involves inherent risk of injury or health complications. By using any Ezia Service—including in-person training, group fitness classes, equipment use, or any digital fitness content—you represent and warrant that:

  • You have consulted, or will consult, with a licensed physician or qualified healthcare provider before beginning any new fitness program or using our facilities;

  • You are aware of and accept the physical risks associated with exercise, including but not limited to muscular strain, joint injury, cardiovascular stress, and exacerbation of pre-existing conditions; and

  • You will immediately inform Ezia staff of any change in your health status that may affect your safe participation.

Ezia staff and trainers are not licensed physicians or medical professionals. Nothing communicated to you by Ezia personnel or published on our Site constitutes medical advice, diagnosis, or treatment.
 

2.2  Limitation of Liability and Assumption of Risk
 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EZIA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, TRAINERS, AND INDEPENDENT CONTRACTORS (COLLECTIVELY, THE “EZIA PARTIES”) SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, INCLUDING WITHOUT LIMITATION: (A) PERSONAL INJURY, BODILY HARM, ILLNESS, OR DEATH; (B) LOSS OF OR DAMAGE TO PERSONAL PROPERTY; OR (C) ANY ERROR, OMISSION, INTERRUPTION, OR DEFECT IN THE SERVICES.

This limitation applies regardless of the theory of liability (negligence, contract, strict liability, or otherwise) and even if an Ezia Party has been advised of the possibility of such damages. Where liability cannot be excluded by law, it is limited to the fullest extent permitted. Your use of the Services is entirely at your own risk.
 

2.3  Indemnification
 

You agree to defend, indemnify, and hold harmless the Ezia Parties from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit or transmit through the Services.
 

2.4  Membership Conduct
 

Membership in Ezia is a privilege, not a right. Members are expected to:

  • Treat all staff, trainers, and fellow members with courtesy and respect;

  • Follow all posted facility rules, safety guidelines, and staff instructions;

  • Refrain from any behavior that is harassing, threatening, discriminatory, or disruptive to the club environment; and

  • Properly use and return equipment and maintain reasonable cleanliness standards in all facility areas.

Ezia reserves the right, in its sole discretion, to suspend or permanently terminate the membership of any individual who violates the conduct standards above, without refund of prepaid fees, subject to any notice requirements in your Membership Agreement.
 

2.5  Billing, Cancellations & Refunds
 

  • Recurring Billing: By enrolling in a membership, you authorize Ezia (or its designated billing processor) to charge your payment method on a recurring basis at the rate and frequency specified during enrollment.

  • Cancellation: Membership cancellations must be submitted in accordance with the notice period set forth in your specific Membership Agreement (typically thirty (30) days’ advance written notice). Cancellations received after the notice deadline may result in one additional billing cycle charge.

  • Refunds: All fees paid are generally non-refundable except as required by applicable law or expressly stated in your Membership Agreement. Any promotional or prepaid plan terms govern refund eligibility for those arrangements.

  • Price Changes: Ezia reserves the right to modify membership rates with reasonable advance notice as specified in your Membership Agreement.
     

2.6  Intellectual Property
 

All content on the Site—including but not limited to text, graphics, logos, images, video, audio clips, fitness programming, and software (collectively, the “Content”)—is the exclusive property of Ezia or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Content for your own personal, non-commercial purposes only.

You may not reproduce, distribute, modify, create derivative works from, publicly display, transmit, or otherwise exploit any portion of the Content without the prior express written consent of Ezia. Any unauthorized use will constitute an infringement of Ezia’s intellectual property rights and may result in civil or criminal liability.
 

2.7  Third-Party Links
 

The Site may contain links to third-party websites or services. These links are provided for informational convenience only. Ezia does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party site. Your use of third-party sites is governed by their respective terms and policies.
 

2.8  Governing Law & Dispute Resolution
 

These Terms shall be governed by and construed in accordance with the laws of the State of [Insert State], without regard to its conflict-of-law provisions. Ezia Athletic Club is committed to ensuring equal access and meaningful participation for all individuals, including persons with disabilities. This Accessibility Statement describes our ongoing efforts to provide an inclusive experience both on our digital platforms and within our physical facility.
 

3.1  Our Commitment
 

Ezia believes that accessibility is a fundamental right, not an afterthought. We are committed to maintaining and improving the accessibility of our website and facility in compliance with applicable law, including the Americans with Disabilities Act of 1990, as amended (ADA), Section 508 of the Rehabilitation Act, and applicable state accessibility regulations.
 

3.2  Digital Accessibility
 

We strive to design and maintain our website in conformance with the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, published by the World Wide Web Consortium (W3C). Our accessibility goals include:

  • Barrier-free pathways and entrances, including automatic or wide-clearance doors;

  • Accessible fitness equipment where available;

  • Staff trained and available to assist members with disabilities upon request; and

  • Clear and visible wayfinding signage in compliance with ADA standards.

We conduct periodic reviews of our physical facilities and are committed to addressing accessibility deficiencies promptly. If you require a specific accommodation to access or enjoy our club, we encourage you to notify our management team in advance so that we may make appropriate arrangements.
